Civilian Evidence Officers are responsible for the preservation, destruction, and release of all items placed in their care. Evidence Officers are trained in storage techniques to ensure that the integrity of evidence is maintained.

Stolen or Embezzled Property

Property has been taken from you which is allegedly stolen or embezzled. Upon filing a Declaration of Ownership, and after you have been allowed to be heard on the matter, the property may be turned over to the person claiming to be the true owner, after all the criminal investigation is complete. If criminal charges are filed, refer to the evidence text below.

Domestic Violence

Weapons that have been seized pursuant to a court order will be held pursuant to the Court order and will be released or disposed of as provided in the court order, or in a subsequent court order. See also, Evidence and Safekeeping below.

Evidence

Wait 90 days after adjudication of your case to contact the Evidence Officer for information regarding the release of your property. If your name and your correct address were provided to the officer or deputy at the time the receipt was given to you, you should receive a letter from the Evidence Officer notifying you to make an appointment to retrieve your property.

Safekeeping

Items are held for 90 days for pick-up by the owner. After 90 days, the items will be considered abandoned.

Weapons

Before any weapons are released, a background check is performed to ascertain your eligibility to receive these weapons.

Medical Marijuana

The Sheriff's Office will not return medical marijuana to Oregon Medical Marijuana Program (OMMP) participants. Under the federal Controlled Substances Act, Congress has designated marijuana as a Schedule I controlled substance. As a consequence, possession of even personal use amounts of marijuana is a violation of federal law under 21 USC § 844(a), and distribution of marijuana to another person is a violation of federal law under 21 USC § 841(a).  Accordingly, the Sheriff's Office would be violating federal law by returning medical marijuana to anyone, including an OMMP participant.

Unclaimed property auction

All unclaimed property is ultimately destroyed or auctioned. We use an online auction service that assists us in getting a true value return on items submitted, additionally, it tries to assist victims in getting their property back.

Reduce property loss

Inscribing property can increase the likelihood that stolen or lost items are returned to you. The best way to inscribe your property is by etching your driver's license or identification number and state (OR5555555DL or OR5555555ID). Property marked in this manner is easier to return to owners and is more difficult to alter. It is important to always document serial numbers and inscribe owner identification on items of value.
