Prior to attending any diversion course, you must appear in court, in person, to sign up for the diversion program unless you have requested permission from the Court, in writing, to enter by mail due to residing a significant distance from the Court and the Court has granted this request.
The Traffic School Diversion Program is designed to allow drivers the opportunity to recognize, review and improve their driving habits, attitudes and behaviors. Generally, you qualify to request diversion if you meet all of the following conditions:
- You do not have a commercial driver license (CDL) or permit
- You have not previously participated in a similar diversion program within the last four years
- You have had no violations or criminal driving convictions within the last four years: and
- You have no other pending violations or criminal driving allegations in this or any other court
If you qualify for the diversion program and the Court grants your request to participate, you will have to attend the course and return the Certificate of Completion to the Court by the date specified by the Court. You will need to pay a class fee directly to the program you attend.
If you qualify for the program, and the Court grants your request to participate, you will need to pay a diversion filing fee to the Court.
Diversion fees are as follows and are non-refundable.
Presumptive Fine on Citation | Diversion Fee |
---|---|
$115.00 | $65.00 |
$165.00 | $90.00 |
$265.00+ | $115.00 |
Minors (under the age of 18) | $65.00 |
Seat Belt Diversion | $40.00 |
A plea of Guilty or No Contest is required to enter the diversion program. Proceeding to trial forfeits the ability to request diversion.
If the charges on your citation are for 30 miles per hour, or more, over the posted speed limit, Speed Racing, Careless Driving, or if an accident occurred, you must appear before the judge to request to be allowed into the program.
If you are a minor (under the age of 18, or 18 and still in high school) you must appear before the judge with a parent or legal guardian who is willing to sign off on the agreement to request to be allowed into the program.
To successfully complete the program, which will result in the citation and the fine(s) being dismissed, you must:
- Sign the Agreement and pay the filing fee
- Complete the class designated by the Court and provide the Court with a copy of the Certificate of Completion on or before the deadline; and
- Not receive any violations or criminal driving charges for 1 year from the date you enter the program.
