Frequently Discussed Development Applications

We sometimes hear from many in our Washington County community about certain development applications, asking for updates and documents. These applications have generated a lot of questions and comments.

The proposed irrigation pond dredging Portland Golf Club and the proposed In-N-Out Burger are examples of development applications that have generated a lot of interest. Documents related to these projects are available below.

In-N-Out Burger: Casefile L2200066


Update 08/19/2024: The LUBA issued its Final Opinion and Order affirming an Independent Hearings Officer’s approval for development of an In-N-Out Burger drive-thru restaurant at 10565 SW Beaverton Hillsdale Highway.

Update 05/14/2024: A Notice of Intent to Appeal the Hearings Officer's April 16, 2024, Notice of Decision was filed with LUBA on May 6.

Update 04/17/2024: The application was approved by an independent Hearings Officer in a Notice of Decision issued April 16, 2024. As part of the In-N-Out application, a Special Use permit, Development Review and Property Line Adjustment were also approved.

The approval is contingent upon the applicant meeting conditions of approval. (See “Conditions of Approval,” page 51 of the Notice of Decision.) Copies of the Hearings Officer’s decision were mailed to parties of record for the application.

The Hearings Officer’s decision can be appealed to the Oregon Land Use Board of Appeals (LUBA) by parties of record only through May 7.

Update 03/26/2024: Testimony and evidence were received at the Public Hearing on the Remand from the Oregon Land Use Board of Appeals (LUBA) of the County Hearings Officer's denial of Special Use and Development Review and two Property Line Adjustments. The record will be held open until 4 pm. April 2, 2024, for final argument by the applicant. The Hearings Officer's written decision is expected by April 16, 2024.

Update 03/19/2024: Staff Comment on Remand of Final Order and Opinion 2022-083 (In-N-Out Application)

Update 03/08/2024: Public hearing on the Remand from the Oregon Land Use Board of Appeals (LUBA) of the County Hearings Officer's denial of Special Use and Development Review and two Property Line Adjustments. The Public Hearing will be virtual at 9 a.m. March 26. (See agenda below for details.) Testimony and evidence received at this hearing will be limited to issues remanded to the County by LUBA Final Order & Opinion No. 2022-083.

Update 10/23/2023: LUBA remanded the applicant's motion to appeal.

Update 05/12/2023: The applicant has filed a Motion to Resume Appeal with the Oregon Land Use Board of Appeals.

Update 07/19/2023: Washington County Development Review/Current Planning issued a conditional land use decision approving this application on May 26 – after the May 23 statutory 120-day deadline. Community Participation Organization (CPO) 3 filed an appeal on June 15.

The Portland Golf Club filed a mandamus action in Washington County Circuit Court on July 18. This action seeks to terminate the appeal on the basis of Washington County Development Review/Current Planning’s failure to take final action on the application, including resolution of any local appeals, before the May 23 statutory 120-day deadline.

The applicant must meet Conditions of Approval (see Notice of Decision and Staff Report, Appendix B) which include required regulatory environmental permits before work can begin. Learn more

Update 06/07/2023: An appeal has been filed by Community Participation Organization (CPO) 3.
